Early Notice and Public Review of a Proposed
Activity in a Federal Flood Risk Management Standard Designated Floodplain and/or Wetland
To: All interested Agencies, Groups and Individuals
This is to give notice that HUD under 24 CFR Part 50 or Responsible Entity under 24 CFR Part 58 has determined that the following proposed action under Section 221(d)(4) of the National Housing Act is located in the Federal Flood Risk Management Standard (FFRMS) floodplain, and HUD or Responsible Entity will be identifying and evaluating practicable alternatives to locating the action within the FFRMS floodplain and the potential impacts on the FFRMS floodplain from the proposed action, as required by Executive Order 11988, Executive Order 11990 and/or Executive Order 13690, in accordance with HUD regulations at 24 CFR 55.20 in Subpart C Procedures for Making Determinations on Floodplain Management and Protection of Wetlands. The proposed project is located at State Highway 183 & Creedmoor Drive in Travis County, Texas. The extent of the FFRMS floodplain was determined using the 0.2-Percent-Annual-Chance Floodplain Approach (0.2 PFA). The subject property, which is referred to as William Cannon Apartments, is occupied by agricultural land with a single-family residence and consists of an irregular shaped parcel containing approximately 14.00-acres (609,840-square feet). Proposed site activities consist of construction of a multi-family residential complex that will contain 276 residential units to be completed in approximately 2027. Based on the results of the FFRMS analysis, 0.01-acres (500-square feet) of FFRMS floodplain is located on the subject property. In addition, 0.01-acres (500-square feet) wetlands will be impacted on the subject property.
There are three primary purposes for this notice. First, people who may be affected by activities in the FFRMS floodplain and/or wetland and those who have an interest in the protection of the natural environment should be given an opportunity to express their concerns and provide information about these areas. Commenters are encouraged to offer alternative sites outside of the FFRMS floodplain and/or wetland, alternative methods to serve the same project purpose, and methods to minimize and mitigate project impacts on the floodplain and/or wetland. Second, an adequate public notice program can be an important public educational tool. The dissemination of information and request for public comment about the FFRMS floodplain and/or wetland can facilitate and enhance Federal efforts to reduce the risks and impacts associated with the occupancy and modification of these special areas. Third, as a matter of fairness, when the Federal government determines it will participate in actions taking place in the FFRMS floodplain and/or wetland, it must inform those who may be put at greater or continued risk.

APPLICATION AND PRELIMINARY DECISION. US Trinity Smithwick, LLC, 200 Highland Circle, Argyle, Texas 76226, has applied to the Texas Commission on Environmental Quality (TCEQ) for a new permit, TCEQ Permit No. WQ0016564001 to authorize the disposal of treated domestic wastewater at a daily average flow not to exceed 180,000 gallons per day via surface irrigation of 70.2 acres of public access golf course. This permit will not authorize a discharge of pollutants into water in the state. TCEQ received this application on June 25, 2024.
The wastewater treatment facility and disposal site will be located approximately 0.25 miles southwest of the intersection of County Road 344 and Old Ranch-to-Market Road 1431, in Burnet County, Texas 78654. The wastewater treatment facility and disposal site will be located in the drainage basin of Lake Travis in Segment No. 1404 of the Colorado River Basin. The TCEQ Executive Director has completed the technical review of the application and prepared a draft permit. The Commission may only grant a request for a contested case hearing on issues the requestor submitted in their timely comments that were not subsequently withdrawn. If a hearing is granted, the subject of a hearing will be limited to disputed issues of fact or mixed questions of fact and law relating to relevant and material water quality concerns submitted during the comment period.
