ORDER AND NOTICE OF HEARING
On the 21st day of May, 2026, the Court received the original petition filed under Chapter 1205 of the Texas Government Code (the "Petition") by the City of Austin, Texas (the "City" or "Petitioner"). This in rem proceeding and mandatory class action is brought by the City in connection with the City of Austin, Texas, Special Tax Revenue Bonds Series 2026 (Convention Center Project) (the "Convention Center Bonds"), and the public security authorizations relating thereto, as more fully described in the Petition, available from the clerk's office.
Among other things, Petitioner seeks a declaratory judgment that validates the legality of the Convention Center Bonds and the public security authorizations related thereto. The scope of relief requested by the City includes a declaratory judgment confirming that: (1) that the City has the authority to issue the Convention Center Bonds; (2) that the City was and is authorized to have taken each public security authorization relating to the Convention Center Bonds; (3) that each public security authorization and expenditure of money relating to the Convention Center Bonds was and is legal and valid; (4) that the City's pledge of the Pledged Revenues (as defined in the Petition) to the repayment of the Convention Center Bonds is legal and valid; and (5) that the Convention Center Bonds are legal and valid. Petitioner also seeks a permanent injunction against the filing by any person of any proceeding contesting the validity of: the Convention Center Bonds, any public security authorization taken in connection with the Convention Center Bonds, any expenditure of money relating to the Convention Center Bonds described in the Petition; each provision made for the payment of the Convention Center Bonds or of any interest on the Convention Center Bonds, and any adjudicated matter and any matter that could have been raised in the action. A full description of the lawsuit and the relief sought, including a more detailed description of the Convention Center Bonds, is contained in the City's Petition, In re: The City of Austin, Texas, Special Tax Revenue Bonds, Series 2026 (Convention Center Project), Cause No. D-1-GN-26-004095, in the 53rd Judicial District Court of Travis County, Texas, and is available for review from the clerk's office.
IT IS ORDERED that the Attorney General of the State of Texas, and any persons who (1) reside in the territory of the City; (2) own property located within the boundaries of the City; (3) are taxpayers of the City; or (4) have or claim a right, title, or interest in any property or money to be affected by a public security authorization or the issuance of the public securities (the "Interested Parties") have the right to appear for trial and show cause why the Petition should not be granted, a permanent injunction entered, and judgment rendered as more fully described therein.
IT IS FURTHER ORDERED that the clerk of this Court, with the assistance of Petitioner, must cause a substantial copy of this order to be published in a newspaper of general circulation in Travis County, Texas, once each week for two consecutive weeks, with the date of the first publication to be not less than 14 days prior to the date of the hearing set forth below. The Court finds that compliance with this order will satisfy the notice requirements of Chapter 1205 of the Texas Government Code.
IT IS FURTHER ORDERED that the aforementioned Petition is set for hearing and trial at 10:00 a.m. on Monday, June 15, 2026, which is the first Monday following the 20th day after the date of this order. The hearing and trial will be conducted at the Travis County Civil and Family Courts Facility, 1700 Guadalupe St., Austin, Texas 78701. Please note that this case is not specially assigned to a particular judge under the Travis County Local Rules, so the parties must check the docket setting prior to each proceeding whether online at https://www.traviscountytx.gov/courts/files/dockets/civil-district or in person at the Travis County Civil and Family Courts Facility in order to determine the courtroom assigned for this proceeding. Assignments will be posted on Friday of the week before the proceeding.
