LAS REVISIONES PROPUESTAS AL CAPÍTULO 116 DE 30 TAC Y AL PLAN DE IMPLENTACIÓN ESTATAL
La Comisión de Calidad Ambiental de Texas (la comisión) llevará a cabo una audiencia pública para recibir testimonios sobre las revisiones propuestas a la sección 116.605 del Capítulo 116, "Control de la contaminación atmosférica mediante permisos para nueva construcción o modificación" del Título 30 del Código Administrativo de Texas (30 TAC, por sus siglas en inglés) y las revisiones correspondientes al plan de implementación estatal (SIP, por sus siglas en inglés) bajo los requisitos de la sección 382.017 del Código de Salud y Seguridad de Texas, el Capítulo 2001, Subcapítulo b del Código de Gobierno de Texas, y la sección 51.102 del Título 40 del Código de Regulaciones Federales de la Agencia de Protección Ambiental de los Estados Unidos (EPA, por sus siglas en inglés) en relación con los SIP.
A fin de implementar los requisitos de los Proyectos de Ley del Senado (SB, por sus siglas en inglés) 763 y 2351 de la 89ª Sesión Regular de la Legislatura Texas de 2025, la comisión propone enmendar el Subcapítulo F ("Permisos estándar") del Capítulo 116 del 30 TAC. La reglamentación propuesta agregaría la sección 116.305(d)(4) que requeriría llevar a cabo una revisión de la protección del Permiso Estándar de Calidad del Aire para Plantas Mezcladoras de Concreto (CBP SP, por sus siglas en inglés) por lo menos una vez cada ocho años. Asimismo, la reglamentación propuesta agregaría las secciones 116.605(f)(1) y (2) que serían aplicables solamente cuando la comisión emita una enmienda ya sea al CBP SP o al Permiso Estándar de Calidad del Aire para Plantas Mezcladoras de Concreto con Controles Mejorados. Dichas nuevas secciones establecerían los criterios sobre cómo la comisión podría requerir que un operador de una instalación permanente que está autorizada a iniciar construcción nueva bajo el permiso estándar anterior actualice los planes de la instalación permanente para la nueva construcción a fin de que cumplan con el permiso estándar modificado si el operador de la instalación no comenzó la construcción antes de la adopción del permiso estándar modificado y el operador presentó una solicitud de extensión para comenzar la construcción.
La comisión llevará a cabo una audiencia pública en formato híbrido (tanto presencial como virtual) sobre esta propuesta en Austin el 20 de noviembre de 2025 a las 2:00 p. m. en el Salón 201S del Edificio E de sus oficinas centrales ubicadas en 12100 Park 35 Circle. La audiencia está estructurada para la recepción de comentarios orales o por escrito de parte de personas interesadas, las cuales podrán presentar comentarios al ser llamadas por orden de inscripción. PROPOSED REVISIONS
TO 30 TAC CHAPTER 116 AND TO THE STATE
IMPLEMENTATION PLAN
The Texas Commission on Environmental Quality (commission) will conduct a public hearing to receive testimony regarding proposed revisions to 30 Texas Administrative Code (TAC) Chapter 116, Control of Air Pollution by Permits for New Construction or Modification, §116.605, and corresponding revisions to the state implementation plan (SIP) under the requirements of Texas Health and Safety Code, §382.017; Texas Government Code, Chapter 2001, Subchapter B; and 40 Code of Federal Regulations §51.102 of the United States Environmental Protection Agency (EPA) concerning SIPs.
To implement the requirements of SB 763 and SB 2351, 89th Regular Texas Legislature, 2025, the commission proposes to amend 30 TAC Chapter 116, Subchapter F (Standard Permits). The proposed rulemaking would add §116.605(d)(4) requiring a protectiveness review to be conducted for the Air Quality Standard Permit for Concrete Batch Plants (CBP SP) at least once every eight years. The proposed rulemaking would also add §116.605(f)(1) and (2) that would be applicable only when an amendment to CBP SP or the Air Quality Standard Permit for Concrete Batch Plants with Enhanced Controls is issued by the commission. New §116.605(f)(1) and (2) would outline criteria of how the commission may require an operator of a permanent facility that is authorized to begin new construction under the former standard permit to update the permanent facility's plans for the new construction to comply with the amended standard permit if the facility operator did not begin the construction before the adoption of the amended standard permit and the operator filed a request for an extension to begin construction.
The Commission will hold a hybrid in-person and virtual public hearing on this proposal in Austin on November 20, 2025, at 2:00 p.m. in Building E, Room 201S, at the commission's central office located at 12100 Park 35 Circle. The hearing is structured for the receipt of oral or written comments by interested persons. Individuals may present oral statements when called upon in order of registration. Open discussion will not be permitted during the hearing; however, commission staff members will be available to discuss the proposal 30 minutes prior to the hearing.
Individuals who plan to attend the hearing virtually and want to provide oral comments and/or want their attendance on record must register by Tuesday, November 18, 2025. To register for the hearing, please email Rules@tceq.texas.gov and provide the following information: your name, your affiliation, your email address, your phone number, and whether you plan to provide oral comments during the hearing. APPLICATION AND PRELIMINARY DECISION. Travis County Municipal Utility District No.22, 4301 Westbank Drive, Suite B-130, Austin, Texas, 78746, has applied to the Texas Commission on Environmental Quality (TCEQ) for a major amendment to TCEQ Permit No.WQ0015201001. The proposed amendment requests to relocate effluent disposal area and adjusting the flow phases, while keeping the final flow rate the same as existing permit. The current permit authorizes the disposal of treated domestic wastewater at a daily average flow not to exceed 450,000 gallons per day via public access subsurface area drip dispersal system with a minimum area of 104.79 acres. This permit will not authorize a discharge of pollutants into waters in the State. TCEQ received this application on February 25,2025.
The wastewater treatment facility and disposal site are located 3.2 miles west of the intersection of state Highway 71 and Hamilton pool Road in Travis County, Texas 78738.
