Final Notice and Public Explanation of a Proposed Activity in a Federal Flood Risk Management Standard Designated Floodplain and/or Wetland

This is to give notice that HUD under 24 CFR Part 50 or Responsible Entity under 24 CFR Part 58 has conducted an evaluation as required by Executive Order(s) 11988, Executive Order 11990 and/or Executive Order 13690, in accordance with HUD regulations at 24 CFR 55.20 in Subpart C Procedures for Making Determinations on Floodplain Management and Wetlands Protection. The activity is funded under Section 221(d)(4) of the National Housing Act. The proposed project is located at State Highway 183 & Creedmoor Drive in Travis County, Texas. The extent of the FFRMS floodplain was determined using the 0.2-Percent-Annual-Chance Floodplain Approach (0.2 PFA). The subject property, which is referred to as William Cannon Apartments, is occupied by agricultural land with a single-family residence and consists of an irregular shaped parcel containing approximately 14.00-acres (609,840-square feet). Proposed site activities consist of construction of a multi-family residential complex that will contain 276 residential units to be completed in approximately 2027. Based on the results of the FFRMS analysis, 0.01-acres (500-square feet) of FFRMS floodplain is located on the subject property. In addition, 0.01-acres (500-square feet) wetlands will be impacted on the subject property.
HUD or Responsible Entity has considered the following alternatives and mitigation measures to minimize adverse impacts and to restore and preserve natural and beneficial functions and intrinsic values of the existing FFRMS floodplain and/or wetland: (1) With the minimized FFRMS floodplain impacts for the proposed development, the no action alternative is favored for rejection because it will not satisfy the requirements for a housing project that will meet the housing demand and revitalization within the Travis County area. (2) The William Cannon Apartments Project was partially selected due to its proximity to transit and retail opportunities. (3) In order to provide appealing amenities as well as developable space for both the proposed project, impact to FFRMS floodplain and/or wetland is necessary. (4) The Accept as Proposed alternative is preferred due to ability to minimize and mitigate the effects of the proposed ground disturbances within the FFRMS floodplain and/or wetland. The proposed activity is in an area where the demand for multi-family dwellings is high; no displacement of residents will occur; zoning requirements are met; good access is available; and adequate buildable area with minimal impacts to the FFRMS floodplain areas and/or wetland is provided. The Sponsor has designed a plan that minimizes FFRMS floodplain and/or wetland impacts to the greatest extent practicable.
HUD or Responsible Entity has reevaluated alternatives to building in the FFRMS floodplain and/or wetland and has determined that it has no practicable alternative to FFRMS floodplain and/or wetland development. Environmental files documenting compliance with Executive Orders 11988, 11990, and/or 13690 are available for public inspection, review and copying upon request at the times and location delineated in the last paragraph of this notice for receipt of comments.
There are three primary purposes for this notice. First, people who may be affected by activities in the FFRMS floodplain and those who have an interest in the protection of the natural environment should be given an opportunity to express their concerns and provide information about these areas. Second, an adequate public notice program can be an important public educational tool. The dissemination of information and request for public comment about the FFRMS floodplain and/or wetland can facilitate and enhance Federal efforts to reduce the risks and impacts associated with the occupancy and modification of these special areas. Third, as a matter of fairness, when the Federal government determines it will participate in actions taking place in the FFRMS floodplain and/or wetland, it must inform those who may be put at greater or continued risk.
