NOTICE OF REQUIREMENT TO COMPLY WITH SUBDIVISION AND SERVICE EXTENSION POLICIES OF MANVILLE WATER SUPPLY CORPORATION
Pursuant to section 13.2502 of the Texas Water Code. Manville Water Supply Corporation ("the utility") gives notice that any person who subdivides land by dividing any lot, tract, or parcel of land within the service area of the utility into two or more lots or sites for the purpose of sale or development whether immediate or future, including resubdivision of land for which a plat has been filed, or who requests multiple service connections on a single contiguous tract must comply with the extension policy of the utility and with it's rules and regulations concerning service to subdivisions and other developments. The utility is not required to extend retail water utility service to a service applicant in a development or subdivision where the developer or seller has failed to comply with the utility's extension policy or it's rules and regulations concerning service to subdivisions and other developments. Applicable elements of those policies, rules, and regulations include: evaluation by the utility of the impact the proposed extension of service will have on system; the payment of all off-site and on-site extension costs, impact fees and other fees and charges promulgated under the authority of the tariff; forfeiture of tentatively approved capacity or service for nonpayment of applicable fees or noncompliance with the rules, regulations and policies of the utility; construction of facilities according to designs reviewed, inspected, and approved by the utility; and dedication by the developer of facilities and infrastructure following inspection and approval.
