Notice is hereby given that the Board of Directors (the "Board") for the Rivers Market Place Municipal Management District (the "District") will hold a public hearing to accept public comments and discuss the request (the "Request"), filed by AV ELGIN 46, LP a Texas Limited Partnership ("AV Elgin 46 LP"), AV ELGIN 46 QOF, LP a Texas Limited Partnership ("AV Elgin 46 QOF LP") and MRRM QOZP LP a Delaware Limited Partnership ("MRRM QOZP LP"), who are the owners of a majority of the assessed value of the approximately 59.987 acres within the boundaries of the District (the "Owner"), requesting that the Board consider the advisability and nature of improvements within the District and levy special assessments on property owned by the Owner within the boundaries of the District.
Time and Place of the Hearing. The public hearing will start at 12:00 p.m. on June 23, 2026, at Winstead PC, 600 W. 5th Street, Suite 900, a designated meeting place located outside the District. Should the provisions of the Open Meetings Act requiring the meeting of the board of directors to be held in person be suspended, the hearing will be held by telephone conference.
General Nature of the Proposed Authorized Improvements. The purposes of the District include the design, acquisition, construction, and improvement of certain improvement projects authorized by Chapter 4022, Texas Special District Local Laws Code, as amended (the "District Legislation") and Chapter 375, Texas Local Government Code (the "Act"), that are necessary for the development of the Property, which include: (i) street and roadway improvements, including related sidewalks, drainage, utility relocation, signalization, landscaping, lighting, signage, off-street parking and right-of-way; (ii) establishment or improvement of parks and open space, together with the design, construction and maintenance of any ancillary structures, features or amenities such as trails, playgrounds, walkways, lighting and any similar items located therein; (iii) sidewalks and landscaping, including entry monuments and features, fountains, lighting and signage; (iv) acquisition, construction, and improvement of water, wastewater and drainage improvements and facilities; (v) the acquisition of real property or any interest in real property in connection with an improvement, project, or services authorized by the Act, or the District Legislation (vi) projects similar to those listed in subsections (i) - (v) above authorized by the District Legislation, or the Act as amended, including similar off-site projects that provide a benefit to the property within the District; (vii) payment of costs associated with operating and maintaining the improvements listed in subparagraphs (i) – (vi) above; and (viii) payment of costs associated with developing and financing the improvements listed in subparagraphs (i) – (vi) above, and costs of establishing, administering, and operating the District and administering and collecting special assessments against the Proposed Assessed Property (the "Authorized Improvements.")
Estimated Cost of the Authorized Improvements. The estimated cost to design, acquire and construct the Authorized Improvements is $30,000,000.
Proposed District Boundaries. The District includes approximately 59.987 acres of land generally located in Bastrop County as more particularly described by a metes and bounds description available at the offices of Winstead PC, c/o Ross Martin, 2728 N. Harwood Street, Suite 500, Dallas, Texas 75201 and available for public inspection.
Proposed Method of Assessment. The Board shall levy assessments on each parcel within the District in a manner that results in imposing equal shares of the costs on property similarly benefited. All assessments may be paid in full at any time (including interest and debt), and certain assessments may be paid in annual installments (including interest and debt). If an assessment is allowed to be paid in installments, then the installments must be paid in amounts necessary to meet annual costs for those Authorized Improvements financed by the assessment, and must continue for a period necessary to retire the indebtedness of those Authorized Improvements (including interest).
Proposed Apportionment of Cost between the Area to be Assessed and the District. The District will not be obligated to provide any funds to finance the Authorized Improvements, other than from special assessments levied on the area to be assessed within the District. No municipal property or District property in the District shall be assessed. Owner may also pay certain costs of the improvements from other funds available to the Owner.
